1. Acceptance of Terms

By downloading, installing, or using Matcha (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

Matcha is a caffeine tracking application designed to help users monitor caffeine intake and optimize their sleep schedule. The App provides:

• Caffeine intake logging with a database of about 400 drinks
• Live coffee cutoff and sleep-ready time
• “What can I drink?” suggestions and tonight's sleep forecast
• Sleep impact previews before you drink
• Cutoff reminders
• Sleep score, sleep tips and insights
• Apple Watch companion app
• Home Screen and Lock Screen widgets, plus a Live Activity countdown
• Siri & Shortcuts
• Apple Health integration
• Custom drinks and favorites
• Multiple color themes

4. Eligibility

To use the App, you must:

• Have a compatible iPhone or iPad (iOS/iPadOS 18.6 or later)
• Agree to these Terms and our Privacy Policy

The App is intended for a general audience. Its current age rating is shown on its App Store page.

5. Free and Pro Features

5.1 Free Features

Free users have access to the following, free forever:

• Unlimited drink logging
• Live coffee cutoff (e.g. “Coffee is OK until 3:10 PM”) and sleep-ready time
• “What can I drink?” one-tap tiles
• Tonight's sleep forecast
• Database of about 400 drinks
• Cutoff reminders
• Home Screen widgets (small and medium) and Lock Screen widgets
• Live Activity countdown on the Lock Screen and Dynamic Island
• Siri & Shortcuts
• Apple Health caffeine sync (writes caffeine to Apple Health)
• 7-night sleep chart
• 7 days history
• Apple Watch app
• Bedtime and caffeine sensitivity settings

5.2 Pro Features (Matcha Pro)

Matcha Pro unlocks:

• “Will it hurt my sleep?” preview before you drink
• Weekly sleep score
• Personal sleep tips
• Apple Health sleep comparison (reads sleep data from Apple Health)
• Unlimited history
• Weekly report with a shareable card
• 5 color themes
• Custom drinks
• Smarter reminders that adapt to what you drank today

6. Subscriptions and Payments

6.1 Subscription Options

Matcha Pro is available in the following plans:

• Monthly: $2.99/month, an auto-renewing subscription billed every month, with a 7-day free trial for eligible new subscribers
• Yearly: $19.99/year, an auto-renewing subscription billed annually, with a 7-day free trial for eligible new subscribers (best value)
• Lifetime: $49.99 one-time purchase with permanent access. Lifetime is not a subscription and does not renew.

Prices shown are in US dollars. Local prices vary by country and currency, and the exact price is shown in the App and on the App Store before you purchase.

6.2 Billing

All payments are processed through Apple's App Store. By purchasing a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase, or when the free trial ends if you started one
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

6.3 Free Trials and Introductory Offers

The Monthly and Yearly plans each include a 7-day free trial for eligible new subscribers. You are not charged during the trial. If you do not cancel at least 24 hours before the trial ends, your Apple ID will be charged the plan's price ($2.99/month or $19.99/year in the US) and the subscription will renew each period until canceled. The Lifetime purchase does not include a free trial.

One-time offer: the App may show a one-time introductory offer (for example, after you close the Matcha Pro screen during setup) for a Yearly subscription at $9.99 (US) for the first year, charged when you subscribe. After the first year, the subscription renews at $19.99/year (US) unless canceled at least 24 hours before the end of the current period.

Free trials and introductory offers are available only to eligible users, as determined by Apple's App Store rules. For example, if you have already redeemed a free trial or introductory offer for Matcha Pro, you may not be eligible for another.

6.4 Refunds

All purchases are final. Refund requests must be made through Apple. Visit reportaproblem.apple.com to request a refund.

7. User Content and Data

• Ownership: You retain ownership of all caffeine logs, custom drinks, and content you create using the App.
• Local Storage: Your caffeine logs, custom drinks and settings are stored locally on your device and, if iCloud sync is on, in your personal iCloud account. We do not have access to your health data, and Apple Health data is never sent to us. See our Privacy Policy for details, including how purchases are handled.
• Responsibility: You are responsible for backing up your data and ensuring its accuracy.

8. User Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer your account or subscription to another person
• Circumvent any access or usage restrictions
• Use the App to store or transmit malicious code
• Misrepresent App-generated data as medical information

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, software, and code, are owned by Wizlab and are protected by international copyright, trademark, and other intellectual property laws.

The drink database includes information about third-party brands (Starbucks, Dunkin', Costa, etc.) for informational purposes only. All brand names and trademarks are property of their respective owners.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or caffeine tracking information
• Health outcomes or sleep quality
• Reliance on App-provided calculations or predictions
• Service interruption or data loss
• Errors in caffeine calculations or sleep predictions
• Any health-related consequences

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Caffeine calculations or sleep predictions will be accurate for your individual metabolism
• The App will meet your health or sleep requirements
• Defects will be corrected

12. Indemnification

You agree to indemnify, defend, and hold harmless Wizlab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your health-related decisions based on App data
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• We are not obligated to refund any fees paid
• Your locally stored data will remain on your device until you delete the App

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Thailand.
